Abstract

Intellectual Property Rights (IPRs) have long played a critical role in shaping the economic, legal, and technological frameworks of nations. With the rapid advancement of Artificial Intelligence (AI) technologies, the significance of IPRs has grown even more pronounced. AI technologies generate vast amounts of data, which can be protected under various IPR mechanisms including patents, copyrights, trademarks, and trade secrets. This research paper delves into the crucial role of IPRs in the realm of AI, examining their influence on innovation, competition, and societal impact.

In the AI sector, IPRs are essential for safeguarding corporate investments and fostering innovation. Patents secure AI-related inventions, copyrights defend creative AI outputs, trademarks protect the identity of AI technologies, and trade secrets keep proprietary information confidential. Nevertheless, the current IPR framework can sometimes impede innovation and restrict access to AI technologies by creating barriers for new market entrants. Additionally, the substantial costs associated with obtaining and enforcing IPRs can be a significant hurdle for small businesses and start-ups, stifling their innovative potential.

To address these challenges, several strategies have been proposed. These include establishing a specialized judicial system for AI-related IPR disputes, creating new IPR categories tailored to the unique characteristics of AI, and encouraging open innovation and collaboration within the AI community. By tackling these issues, we can ensure that the benefits of AI technology are realized in a manner that promotes innovation, protects IPRs, and serves the broader interests of society.
